1. Acceptance of Terms

By installing, accessing, or using Lightning BD ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the Service.

2. Description of Service

Lightning BD is a Google Sheets add-on that enables users to send personalized emails directly from their spreadsheets. The Service integrates with Google Sheets and Gmail to provide email automation functionality.

3. Use License

We grant you a personal, non-transferable, non-exclusive, revocable license to use Lightning BD subject to these Terms. This license is for personal and commercial use.

You may not:

• Modify, reverse engineer, or create derivative works based on the Service
• Copy, distribute, or resell any part of the Service
• Use the Service for any illegal or unauthorized purpose
• Attempt to bypass any limitations or security measures

4. User Obligations and Compliance

You are solely responsible for:

• Complying with all applicable laws, including but not limited to CAN-SPAM Act, GDPR, CCPA, and other privacy and anti-spam regulations
• Obtaining necessary consent from email recipients
• Including unsubscribe mechanisms where required by law
• The content of all emails sent using the Service
• Maintaining the security of your Google account
• All activities that occur under your account

5. Prohibited Uses

You agree NOT to use Lightning BD to:

• Send spam, unsolicited emails, or bulk emails to purchased lists
• Harass, abuse, or harm another person or entity
• Transmit viruses, malware, or malicious code
• Violate any laws or regulations
• Impersonate any person or entity
• Send deceptive, fraudulent, or misleading content
• Exceed Gmail's sending limits or abuse Google's services
• Collect or harvest email addresses without permission

6. Service Availability and Modifications

We strive to maintain Service availability but cannot guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Update these Terms with or without notice
• Impose limits on certain features or restrict access
• Remove or refuse service to users who violate these Terms

7. Privacy and Data

Your use of Lightning BD is also governed by our Privacy Policy. By using the Service, you consent to the data practices described in our Privacy Policy.

You acknowledge that:

• All data remains in your Google account
• We do not store your contacts or email content
• You are responsible for the accuracy and legality of your data

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We expressly disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding security, reliability, timeliness, and performance
• Warranties that the Service will be error-free or uninterrupted
• Email deliverability or inbox placement guarantees

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UK LAW, LIGHTNING BD AND ITS CREATORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages exceeding £100 GBP or the amount paid to us in the past 12 months
• Any matter beyond our reasonable control

These limitations do not apply to liability that cannot be excluded under UK law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

10. Indemnification

You agree to defend, indemnify, and hold harmless Lightning BD, its creators, and affiliates from any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party right or applicable law
• Any content or data you process using the Service
• Any dispute between you and email recipients

11. Google Terms

Your use of Lightning BD is subject to Google's Terms of Service and Google API Services User Data Policy. You must comply with all applicable Google terms and policies.

12. Termination

These Terms remain in effect until terminated by either party. You may terminate by uninstalling the add-on. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:

• Your right to use the Service ceases immediately
• Sections requiring survival (indemnification, limitations, etc.) remain in effect

13. Pricing and Payment Terms

Lightning BD is currently offered free of charge. However, we reserve the right to:

• Introduce paid features, tiers, or subscriptions at any time
• Limit certain features to paid users
• Implement usage limits for free accounts
• Charge for premium support or additional services

Any future paid services will be subject to additional payment terms. Existing users will be notified of any changes to pricing with at least 30 days notice.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

You agree that any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, and you consent to personal jurisdiction in such courts.

IMPORTANT: Nothing in these Terms affects your statutory rights as a consumer under UK law.

15. UK Specific Provisions

In accordance with UK law:

• These Terms do not affect your statutory rights
• Nothing in these Terms limits our liability for death or personal injury caused by negligence
• We cannot exclude liability for fraud or fraudulent misrepresentation
• The limitations of liability apply only to the extent permitted by law

16. Data Protection

We process data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For details, see our Privacy Policy.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Lightning BD regarding the Service and supersede all prior agreements and understandings.
